1. Introduction

These Terms of Service ("Terms") govern your access to and use of ISP Deliverability (the "Service"), operated by ISP Deliverability ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. We will notify registered users of material changes. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Acceptable Use

You may use ISP Deliverability to analyse the deliverability of your own email campaigns and email lists that you have a lawful right to process. You must not:

  • Upload emails or contact lists that you do not own or do not have explicit permission to process.
  • Use the Service to harvest, scrape, collect, or distribute email addresses without consent.
  • Use the Service to facilitate unsolicited bulk email (spam).
  • Attempt to reverse-engineer, decompile, or abuse the API or internal endpoints of the Service.
  • Circumvent, disable, or tamper with security or rate-limiting features of the Service.

3. No Guaranteed Inbox Placement

ISP Deliverability provides heuristic risk estimates based on email content, HTML structure, authentication signals (SPF, DKIM, DMARC), and known spam-filter patterns. Our scores are educational indicators designed to help you identify common deliverability issues.

We do not guarantee actual inbox placement. Whether an email lands in the inbox, spam folder, or is rejected entirely depends on factors outside our control, including: your sender reputation, recipient engagement history, ISP-level filters, and real-time blocklist status. Our scores are estimates only and should not be relied upon as definitive predictions.

4. User Responsibility

You are solely responsible for:

  • The emails and contact lists you upload to the Service.
  • Ensuring you have the legal right and appropriate consent to process the contact data you upload.
  • Complying with all applicable laws, including CAN-SPAM, GDPR, CASL, and any other email marketing or data protection regulations applicable to your jurisdiction and audience.
  • Any actions taken by your team members within your workspace.

5. Prohibited Use

The following uses of the Service are strictly prohibited:

  • Uploading .eml files or contact lists containing malicious content, malware, or phishing material.
  • Systematically scraping or abusing the free tools to extract data at scale.
  • Creating accounts or workspaces for the purpose of sending spam or facilitating spam operations.
  • Attempting to bypass usage limits, rate limits, or plan restrictions through technical means.
  • Sharing account credentials with individuals outside your authorised workspace team.

Violation of these prohibitions may result in immediate account suspension or termination without refund.

6. Payment & Subscription Terms

Paid plans are billed on a monthly or yearly basis, depending on the billing cycle you select. Payments are processed by third-party payment processors: Stripe, PayPal, or Binance Pay. By subscribing, you agree to the applicable payment processor's terms of service.

We reserve the right to change plan pricing with at least 30 days' advance notice to existing subscribers. Price changes will not affect your current billing period.

7. Refunds & Cancellations

Upon cancellation, your access to paid features will continue until the end of your current billing period. We do not offer automatic refunds for unused time within a billing period. 8. Public Reports

ISP Deliverability allows you to generate public shareable report links. Once shared, these links are accessible by anyone with the URL. You are responsible for what you share via public report links and for deciding whether a report contains information you wish to make publicly accessible. You can revoke public access from within the test result view.

9. Limitation of Liability

ISP Deliverability is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular email will achieve inbox delivery.

To the maximum extent permitted by applicable law, ISP Deliverability and its operators shall not be liable for: any email delivery outcomes or failures; business losses, lost revenue, or lost profits; decisions made based on our heuristic scores or AI advice; or any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify registered users by email or via an in-app notice prior to the changes taking effect. The "Last reviewed" date at the top of this page will reflect when the Terms were last updated. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
